These General Terms and Conditions of Sale govern the purchase of products offered for sale on the website store.tolemaide.com.

The user is invited to read these General Terms and Conditions of Sale carefully before placing an order. Browsing the website and submitting a purchase order imply acceptance of these General Terms and Conditions of Sale and of the privacy notices relating to the processing of personal data available on the website.


Art. 1 – General provisions

1.1. These General Terms and Conditions of Sale apply to the online sale of products offered on the website store.tolemaide.com, hereinafter the “Website”.

hereinafter referred to as the “Seller”, the “Supplier” or “Tolemaide”.

1.3. These General Terms and Conditions of Sale govern purchases made on the Website by consumer users and, where applicable, by professional users.

1.4. “Consumer” means any natural person who purchases for purposes unrelated to any entrepreneurial, commercial, craft or professional activity they may carry out.

1.5. The Seller reserves the right to amend these General Terms and Conditions of Sale. Any changes shall be effective from the moment they are published on the Website and shall apply only to orders placed after such publication.


Art. 2 – Subject matter

2.1. These General Terms and Conditions of Sale govern the offer, submission and acceptance of purchase orders relating to products sold through the Website.

2.2. These General Terms and Conditions do not govern the sale of products or the provision of services by third parties that may be present on the Website through links, banners or other hyperlinks.

2.3. Before purchasing products or services from third parties, the user is invited to review their respective terms and conditions of sale.


Art. 3 – Products offered

3.1. Tolemaide sells online women’s costume jewellery, fashion accessories, hair jewellery and other items available in the online catalogue.

3.2. The product offer is detailed in the product sheets available on the Website.

3.3. Product images are for descriptive and illustrative purposes only. Any differences in colour, size or finish may depend on screen settings, photographic lighting or the characteristics of the product.

3.4. Any essential product characteristics, materials, dimensions, colours, availability and price are indicated in the relevant product sheet.


Art. 4 – Conclusion of the contract

4.1. To conclude the purchase contract, the user must select the desired products, add them to the cart and follow the guided procedure available on the Website.

4.2. Before finally submitting the order, the user may check the purchase summary, including the selected products, price, any shipping costs, payment method, delivery address and any additional required information.

4.3. Before completing the order, the user will be asked to confirm that they have read these General Terms and Conditions of Sale, the information on the right of withdrawal and the privacy notice.

4.4. The contract shall be deemed concluded when the Seller receives the user’s order and sends the user an order confirmation by e-mail.

4.5. The order confirmation contains a summary of the products purchased, the price, any shipping costs, the selected payment method, the delivery address and a reference to these General Terms and Conditions of Sale.

4.6. Once the contract has been concluded, the Seller shall process the order.

4.7. The Seller reserves the right not to accept or to cancel incomplete, inaccurate or unpaid orders, orders relating to unavailable products, or orders from parties with whom a dispute is ongoing.


Art. 5 – Registered users

5.1. The user may make purchases on the Website according to the methods made available by the Seller, including through the registration of a personal account, where provided.

5.2. When completing the registration procedures, the user undertakes to provide correct, complete and truthful data.

5.3. The user undertakes to promptly inform the Seller of any changes to the data provided.

5.4. If the user provides inaccurate or incomplete data, the Seller may suspend or not process the order until the necessary data have been corrected.

5.5. The user is responsible for keeping their account login credentials confidential and undertakes not to disclose them to third parties.

5.6. Any activity carried out through the user’s account shall be presumed to have been carried out by the user, unless proven otherwise.


Art. 6 – Product availability

6.1. The availability of products indicated on the Website refers to the time at which the user views the Website.

6.2. Availability must be considered indicative, as products may be purchased simultaneously by multiple users or may become unavailable after the order has been submitted.

6.3. If, even after the order confirmation has been sent, one or more products are totally or partially unavailable, the Seller shall promptly inform the Buyer by e-mail.

6.4. In the event of product unavailability, the Seller may offer the Buyer an alternative solution, a different delivery timeframe or the total or partial cancellation of the order.

6.5. In the event of total or partial cancellation of the order due to product unavailability, the Seller shall refund the Buyer any amounts already paid for the unavailable products without undue delay.


Art. 7 – Prices

7.1. All product prices are indicated on the Website in Euro.

7.2. Prices include VAT, where applicable, and do not include shipping costs unless otherwise stated.

7.3. Shipping costs, where applicable, are indicated during the purchase procedure before the order is submitted and are shown in the order summary.

7.4. The Seller reserves the right to change prices at any time. Changes shall not apply to orders for which an order confirmation has already been sent.

7.5. In the event of an obvious error in the price indicated on the Website, the Seller shall inform the Buyer and allow the Buyer to confirm the order at the correct price or cancel the order with a refund of any amounts already paid.

7.6. Any promotional offers, discounts or special conditions are valid within the limits and for the period indicated on the Website.


Art. 8 – Payment methods

8.1. Payment for products may be made using the methods indicated on the Website during the purchase procedure.

8.2. Available payment methods may include, by way of example, payment cards, PayPal, Apple Pay, Google Pay or other systems that may be activated on the Website.

8.3. The Seller reserves the right to change the available payment methods at any time. For each order, the payment methods indicated at the time the order is submitted shall apply.

8.4. Communications relating to payments and payment data may be managed through specialised third-party systems and providers, using transaction security and encryption tools.

8.5. The Seller does not have access to the full data of the payment instruments used by the Buyer, except to the extent necessary for the management of the order, assistance and any refunds.

8.6. In the event of a refund, the Seller shall use the same means of payment used by the Buyer for the initial transaction, unless otherwise expressly agreed between the parties and without additional costs for the Buyer.


Art. 9 – Delivery

9.1. The Seller ships according to the methods and destinations indicated on the Website during the purchase procedure.

9.2. Delivery shall be made to the address indicated by the Buyer when placing the order or to any available collection points, where provided by the selected shipping service.

9.3. Delivery times indicated on the Website are indicative and may vary depending on product availability, destination and selected shipping method.

9.4. Unless otherwise agreed or otherwise indicated to the Buyer, delivery shall take place within a maximum period of 30 days from the conclusion of the contract.

9.5. If the Seller is unable to meet the indicated delivery times, the Seller shall notify the Buyer by e-mail.

9.6. If delivery cannot be carried out for reasons not attributable to the Seller, the order may be deposited with the courier or at the collection point indicated by the carrier. The Buyer shall be informed of the methods for arranging a new delivery or proceeding with collection.

9.7. If delivery cannot take place for reasons attributable to the Buyer, the Seller may contact the Buyer to arrange a new delivery. Any additional costs arising from storage, return shipment or a new shipment may be charged to the Buyer, within the limits permitted by law.

9.8. Shipping costs shall be borne by the Buyer, unless otherwise indicated on the Website or unless promotional conditions apply.


Art. 10 – Inspection upon delivery and transport damage

10.1. Upon delivery, the Buyer is invited to check that:

a) the number of packages corresponds to what is indicated in the delivery documentation;
b) the packaging is intact, not damaged, not wet, not opened or altered;
c) the product shows no evident damage.

10.2. If the packaging is damaged, opened, wet or tampered with, the Buyer is invited to accept delivery with a specific reservation, indicating on the delivery document wording such as:

“Accepted subject to inspection due to damaged packaging”, specifying the reason.

10.3. In the event of evident damage, the Buyer may refuse delivery and promptly notify the Seller at contatti@tolemaide.com.

10.4. Failure to add a specific reservation shall not prejudice the rights granted to the Consumer Buyer by applicable law, but may make the management of the claim with the courier more complex.


Art. 11 – Transfer of risk and ownership of products

11.1. The risk of loss of or damage to the products shall pass to the Buyer when the Buyer, or a third party designated by the Buyer other than the carrier, physically takes possession of the products.

11.2. If the carrier was chosen by the Buyer outside the options proposed by the Seller, the risk shall pass to the Buyer when the product is delivered to the carrier.

11.3. Ownership of the products shall pass to the Buyer upon full payment of the price and any ancillary costs due.


Art. 12 – Right of withdrawal

12.1. The Consumer Buyer has the right to withdraw from the contract concluded online, without giving any reason, within 14 days from the day on which they receive the product.

12.2. In the case of a single order relating to multiple products delivered separately, the 14-day period shall run from the day on which the Consumer Buyer receives the last product.


Art. 13 – How to exercise the right of withdrawal

13.1. To exercise the right of withdrawal, the Consumer Buyer must inform the Seller of their decision to withdraw from the contract by means of an explicit statement.

13.2. The communication may be sent:

a) by e-mail to contatti@tolemaide.com;
b) through the online function “Withdraw from the contract here”, where available on the Website;
c) using the standard withdrawal form included at the end of these Conditions, the use of which is not mandatory.

13.3. The withdrawal communication must indicate:

a) the Buyer’s name and surname;
b) the order number or another useful reference to identify the contract;
c) the product or products for which the right of withdrawal is being exercised;
d) the e-mail address to which confirmation should be sent;
e) any documentation proving the purchase.

13.4. If the online withdrawal function is used, the Buyer may submit the statement through the specific function available on the Website and confirm the request using the button or command “Confirm withdrawal” or equivalent wording.

13.5. The Seller shall send the Consumer Buyer a confirmation of receipt of the withdrawal on a durable medium, for example by e-mail, without undue delay.

13.6. To meet the withdrawal deadline, it is sufficient for the Consumer Buyer to send the communication before the 14-day withdrawal period has expired.


Art. 14 – Return of products in case of withdrawal

14.1. In case of exercise of the right of withdrawal, the Consumer Buyer must return the products to the Seller within 14 days from the day on which they communicated the withdrawal.

14.2. The deadline is met if the Buyer sends the products before the 14-day period has expired.

14.3. The products must be returned to the following address, unless otherwise indicated by Customer Service:

14.4. Products must be returned intact, complete in all their parts, accessories, any tags, original packaging and packaging materials, where present.

14.5. The Consumer Buyer is responsible for any decrease in the value of the products resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

14.6. The direct costs of returning the products shall be borne by the Consumer Buyer, unless otherwise agreed or otherwise indicated by the Seller.

14.7. For fragile, delicate or particularly valuable products, the Buyer is invited to use suitable packaging and a trackable shipping method.

14.8. The risk of damage during return transport shall remain with the Buyer until redelivery to the Seller, subject to any mandatory provisions applicable to the Consumer.


Art. 15 – Refund in case of withdrawal

15.1. In the event of valid exercise of the right of withdrawal, the Seller shall refund the Consumer Buyer all payments received in relation to the products subject to withdrawal, including any standard delivery costs incurred at the time of purchase.

15.2. Any additional costs arising from the Buyer’s choice of a type of delivery other than the least expensive standard delivery offered by the Seller shall be excluded from the refund.

15.3. The refund shall be made without undue delay and in any case within 14 days from the day on which the Seller was informed of the Consumer Buyer’s decision to withdraw from the contract.

15.4. The Seller may withhold the refund until the products have been received or until the Consumer Buyer has provided evidence of having sent the products back, whichever occurs first.

15.5. The refund shall be made using the same means of payment used by the Buyer for the initial transaction, unless otherwise expressly agreed between the parties and without additional costs for the Buyer.

15.6. If the returned product is damaged, incomplete, used beyond what is necessary to verify its nature, characteristics and functioning, or missing parts, accessories, tags or essential packaging, the Seller may reduce the refund by an amount corresponding to the decrease in value of the product, within the limits permitted by applicable law.

15.7. If the refund cannot be made through the same payment method used for the purchase, the Buyer must provide the details necessary to allow the refund, such as IBAN and account holder. SWIFT/BIC may be requested only where necessary in relation to the payment method or the country of the bank account.


Art. 16 – Exceptions to the right of withdrawal

16.1. Pursuant to Article 59 of the Italian Consumer Code, the right of withdrawal is excluded, among other cases provided for by law, with reference to:

a) products made to measure or clearly personalised;
b) products made or modified according to the Buyer’s specific request;
c) products that are liable to deteriorate or expire rapidly, where applicable;
d) sealed products that are not suitable for return for reasons of hygiene or health protection, if they have been opened after delivery;
e) goods which, after delivery, are, by their nature, inseparably mixed with other goods.

16.2. By way of example, the right of withdrawal may be excluded for items made or modified at the Buyer’s specific request, personalised products, sealed products opened after delivery when they are no longer suitable for return for reasons of hygiene or health protection, and in the other cases provided for by law.

16.3. For items such as earrings, hair jewellery, personal accessories or similar products, if they are delivered sealed, withdrawal may be excluded if the seal has been removed after delivery and the product is not suitable for return for reasons of hygiene or health protection.

16.4. The exclusions from the right of withdrawal shall not prejudice the rights of the Consumer Buyer in the event of a defective, damaged, incorrect or non-conforming product.


Art. 17 – Damaged, incorrect or non-conforming products

17.1. The rules on the right of withdrawal do not limit or replace the rights granted to the Consumer Buyer in the event of a defective, damaged, incorrect or non-conforming product.

17.2. If the Buyer receives a damaged, defective, incorrect or non-conforming product, they are invited to promptly contact the Seller at contatti@tolemaide.com, attaching:

a) order number;
b) description of the issue found;
c) photographs of the product and packaging, where useful;
d) copy of the purchase documentation.

17.3. The Seller shall assess the report and inform the Buyer of how the request will be managed.

17.4. In the event of transport damage, the Buyer is invited to keep the original packaging and submit the report as soon as possible, so that the Seller can carry out the necessary checks with the courier.


Art. 18 – Legal guarantee of conformity

18.1. In relation to the Consumer Buyer, the Seller shall be liable for any lack of conformity of the products existing at the time of delivery and becoming apparent within 2 years from delivery of the goods, in accordance with the Italian Consumer Code.

18.2. In the event of a lack of conformity, the Consumer Buyer is entitled to the remedies provided for by law, including, where the relevant conditions are met, restoring the conformity of the goods, replacement, proportional price reduction or termination of the contract.

18.3. Unless proven otherwise, any lack of conformity that becomes apparent within 1 year from delivery shall be presumed to have existed at that time, unless such presumption is incompatible with the nature of the goods or the nature of the lack of conformity.

18.4. Any action aimed at enforcing lack of conformity rights shall be time-barred within the terms provided for by law.

18.5. The legal guarantee does not cover defects or damage resulting from improper use of the product, negligence, tampering, impacts, falls, improper storage, exposure to external agents incompatible with the nature of the product, or normal wear and tear.

18.6. To exercise the rights relating to the legal guarantee, the Consumer Buyer may contact the Seller at contatti@tolemaide.com, indicating the order number, the product concerned and a description of the defect found.


Art. 19 – Seller’s liability

19.1. The Seller shall not be liable for disruptions or delays resulting from force majeure, unforeseeable circumstances or events that are not foreseeable and not attributable to the Seller.

19.2. The Seller shall not be held liable for Internet network malfunctions, service interruptions, technical problems or disruptions depending on third-party providers, except in cases of wilful misconduct or gross negligence.

19.3. The Seller shall not be liable for damage, losses or costs arising from improper use of the purchased products, failure to comply with instructions for use, improper storage or use not compliant with the nature of the product.

19.4. The mandatory rights granted to the Consumer Buyer by applicable law shall remain unaffected.


Art. 20 – Processing of personal data

20.1. The Seller processes the Buyer’s personal data in compliance with Regulation EU 2016/679 and the applicable legislation on the protection of personal data.

20.2. Personal data are processed for purposes connected with the management of orders, payments, deliveries, customer assistance, returns, tax and accounting obligations and any further obligations required by law.

20.3. For further information on the processing of personal data, the Buyer is invited to consult the Privacy Policy available on the Website.


Art. 21 – Severability clause

21.1. If any provision of these General Terms and Conditions of Sale is deemed null, invalid or ineffective, that provision shall be considered separate from the others and shall not affect the validity and effectiveness of the remaining provisions.

22.2. The Buyer is invited to indicate in the communication the order number, their identification details and a clear description of the request.

22.3. The Seller undertakes to respond to communications and complaints within a reasonable period, depending on the nature of the request.


Art. 23 – Applicable law and competent court

23.1. These General Terms and Conditions of Sale are governed by Italian law.

23.2. For disputes with the Consumer Buyer, the competent court shall be the court of the place of residence or domicile of the Consumer, if located within the territory of the Italian State.

23.3. For disputes with Professional Buyers, the Court of Bologna shall have exclusive jurisdiction, unless otherwise provided by mandatory law.


Art. 24 – Amendments to the General Terms and Conditions of Sale

24.1. The Seller reserves the right to amend these General Terms and Conditions of Sale at any time.

24.2. Amendments shall be effective from the moment they are published on the Website and shall apply to orders placed after publication.

24.3. Orders already concluded shall continue to be governed by the General Terms and Conditions of Sale in force at the time the order was submitted.
